From a doctrinal and jurisprudential approach, the study aims to discuss the interpretive divergences of Article 1,829, I, of the Civil Code that involve the succession position of the spouse, especially concerning conventional separation of property. To achieve the proposed objectives, the inductive method was employed, based on bibliographic, doctrinal, and legislative research, as well as the analysis of relevant articles and documents.
