Traditionally, this principle required physical possession of the instrument for property transfer, but the advent of digital technologies challenges this doctrine. We analyze the issuance, circulation, and transfer of these electronic instruments, as well as how legislations are adapting to this new reality. Through jurisprudence and case studies, we conclude that it is possible to maintain the essence of the negotiability principle, ensuring the security and effectiveness of financial transactions in an increasingly digital and globalized environment.
