The study raises the question of how the social security system can be more equitable and inclusive, considering both personal and environmental factors. These questions will be analyzed in accordance with Complementary Law No. 142/2013, which will address retirement by age and by length of service for persons with disabilities for comparative purposes. The degree of disability of the individual is assessed by a biopsychosocial assessment performed by a multidisciplinary and interdisciplinary team. In addition to comparing the types of retirement, the main objective of this monograph is to specifically study the possibility and applicability of granting retirement to a special insured person with a disability, since LC 142/2013 treats a person without a disability who works as a special insured person equally. A new type of retirement for special insured persons with disabilities was proposed for men and women, in order to compensate for the imbalance faced by special insured persons with disabilities.
