The statements depend on, exclusively, the memories in the attempt of the elucidation of the facts, based on the witness’s recalls, which may not be faithful to the reality of the facts, given the memory’s fallibility. It is common that to the mnemonic process the occurrence of distortions, once the memory is linked to many inside and outside factors that, unconsciously, culminates on false memories. Therefore, in this research it will be made a brief study about the criminal procedure’s proofs, focusing on testimonial proof. Then, a historical and theorical approach on the memory will be done, which will result on the analysis of the false memories. In the end, the reflections of memory’s fallibility will be pointed, as well as the possible techniques to reduce its damages. Considering the complexity of the topic and that there are no easy solutions to complex problems, it is necessary, therefore, to apply damage reduction measures to mitigate the effects of the phenomenon, as well as the collection of testimonial evidence within a reasonable time and the training of operators in the field. would contribute to that end. The study of the false memories in the criminal procedure is indispensable, given that the testimonial proof is the only and/or principal main of evidence used as basis to judicial decisions.
