This paper investigates the flaws in the Brazilian penal system and the inefficiency of custodial sentences. It begins with a historical analysis, showing how Brazil, in the 19th century, replaced physical punishment with imprisonment, but still faces problems such as overcrowding, recidivism and precarious conditions in prisons. Although the purpose of prison was to reintegrate convicts into society, the system fails to prevent recidivism and reintegrate prisoners into society. The study first examines the evolution of the punitive system, demonstrating how the State assumed the power to punish in order to guarantee social order. However, structural problems in the prison system persist, revealing its inability to promote resocialization and social justice. In the second part, the research addresses the system's shortcomings, such as prison overcrowding and the inhumane conditions that aggravate the situation of prisoners. Restorative justice is presented as an alternative to the traditional punitive model, which focuses on punishing the offender. Instead, restorative justice prioritizes reparation of damages and dialogue between the parties involved, aiming to hold the offender accountable in a more humane manner. The paper explores practices such as mediation and restorative circles, which have shown success in other countries and, recently, in Brazil. Finally, the study highlights experiences of applying restorative justice, both in Brazil and in other international contexts, demonstrating its effectiveness in reducing recidivism and promoting a more participatory justice system.
