It addresses the practice of parental alienation, which aims to protect the fundamental rights of children and adolescents during family crises or divorces. The general objective is to analyze the effectiveness of the legislation that ensures the right of children or adolescents to maintain healthy relationships with both parents, promoting equality in parental authority and allowing for monitoring in cases of alienation. The research approach method used in this study is deductive and exploratory, where, through a mental process, particular data are examined and sufficiently verified. The general aim of the thesis was to analyze the applicability of the Parental Alienation Law and its effectiveness. The research question proposed asks whether Law 12.318/2010 is being applied and if it is effective. The research uses the deductive exploratory method through bibliographical and documentary research techniques. It was observed that the lack of balance between parents can result in custody disputes and, consequently, emotional abuse.
