This Law was created to regulate the process that benefits companies with economic and financial difficulties to overcome the crisis in which they find themselves in court. This monograph aimed to analyze the configuration of the judicial recovery requested by the company Comil Ônibus S.A., one of the main bus manufacturers in Brazil, located in the municipality of Erechim, state of Rio Grande do Sul, in order to know what reasons led the company to request the benefit, emphasize the importance of the company for the region and how the judicial recovery was developed. To this end, a bibliographical basis was sought in bankruptcy and commercial law to better understand the rules and the process that involves the recovery of companies in court. In seeking to achieve the research objectives, the descriptive method was used to present the situation and demonstrate the events and business characteristics. As for how the problem is approached, this research is qualitative, as the data and evidence obtained cannot be measured. The case study and the judicial process were the tools used in order to collect information and investigate facts about how the judicial recovery process was carried out in the company approached. With this, the central problem of this research was resolved, by identifying that it was a set of factors, among them, the consequences of the global economic crisis, the rise in raw material prices, the scarcity of credit, high interest rates, which led the company studied to have difficulties with its finances in addition to defaults from the federal government. Finally, it was possible to conclude that the objective of the bankruptcy and judicial recovery legislation, Law 11.101/05, was achieved, Comil Ônibus S.A, the company studied, is restructuring and continuing its business, presenting positive results, preserving jobs and generating income.pt-BRDireitoRecuperação judicialTrabalho de Conclusão de Curso
