Santos, Luciano Alves dosRogalski, Tailine Michele2024-03-042024-03-042021https://repositorio.uricer.edu.br/handle/35974/585The Criminal Execution Law - LEP, based on the principle of the Dignity of the Human Person and other constitutional principles, is the norm applied to those convicted in serving a sentence, in order to ensure them the basic human rights, protecting them from arbitrariness by part of the state. Therefore, the objective of this bibliographical research aims to discuss the effectiveness of the application of LEP in the Brazilian penitentiary system, the main causes of the low rates of resocialization, as well as to present alternatives to improve these rates and corroborate for a less violent society. Thus, an analysis was made of the current Brazilian prison system and the barriers it imposes on the prisoner's resocialization, such as lack of basic health care, hygiene and adequate food caused by prison overcrowding. As well as overcrowding it is one of the main problems for the high rates of criminal recidivism. It is understood that to minimize the problems of a collapsing prison system it is necessary for the joint action of the State and society, and to enable effective alternatives for resocialization, such as alternative sentences, reinsertion of the egress into society, and working on the humanitarian aspect in prisons, in order to change the convict's conscience about the crime, offering conditions so that after serving the sentence, he/she returns to society and finds ways to work and enjoy freedom without prejudice.
