Initially, it discussed the historical aspects of domestic and family violence against women, as well as the advances in laws aimed at women, with the assumption of better understanding the trajectory of the political struggle that had resulted in the enactment of Law 11.340, entitled “Maria da Penha Law”. After we held a discussion of the protective measures involving the defense and support to women in dangerous condition because the heart is the guarantee of the fundamental right to the woman, and the right to a life without violence. Then we held a brief study regarding the responsibility of the impacts of the application of protective measures in the family relationship, especially in the bond of parent and their children, as well as the use of urgent protective measures provided for in statute as a way of parental alienation. With the realization of the research it was possible to identify that the legislator, when approving Law 11.340 / 2006, had the intention of protecting women in vulnerable situations, in particular, with the various measures that can be imposed to avoid any type of violence or threat already occurred in the face of the victim. However, given the urgency that lines the urgent protective measures, it is of paramount importance a detailed and careful analysis of the judge of the case to see if it really is the case of violence or theft of Maria da Penha Law as a form of alienation parental.
