This study investigates the historical and conceptual foundations of civil liability, from its origins in Roman law to its contemporary application, highlighting its evolution over time and its specificities in the sporting context. The analysis of sports legislation reveals the fundamental role of specific regulations in defining the responsibilities of clubs and regulating the behavior of fans. However, a lack of clarity and consistency in laws and management practices often challenges the effectiveness of measures adopted by clubs to deal with incidents in the sporting environment. In this context, the issue of (in)civil responsibility of football clubs for the acts of their fans presents ethical, social and practical challenges, requiring a comprehensive and collaborative approach to promote a safe, fair and inclusive sporting environment for all involved.
