This monographic work aims to analyze parental alienation through the lens of Law No. 12.318/10 within Family Law, seeking to enhance the legislation in favor of children's rights, especially in situations of disempowerment. The research is structured into three chapters. The first chapter provides a historical analysis of the protective rights of minors, focusing on the constitutive elements and the evolution of these rights over time. The second chapter addresses the intrinsic aspects of parental alienation, discussing its concept and the criteria for determining custody of minor children after separation. Finally, the third chapter differentiates parental alienation from the related syndrome and explores the reasons supporting the presumption of the law's ineffectiveness concerning minors. To substantiate the analysis, the methodology employed includes bibliographic and documentary research, utilizing inductive and analytical-descriptive methods.
