Albuquerque, Simone Gasperin deMaria, Gabriela2025-03-202024https://repositorio.uricer.edu.br/handle/35974/828The present work aims to present an analysis of informational self-determination as provided for in article 2, section II of the General Data Protection Law (Law No. 13,709/2018) and the legal basis for the data subject to object to the processing of their personal data. It studies the fundamentals of data protection in Brazil, human rights, and personality development. It analyzes the General Data Protection Law and its legal definitions, specifically regarding personal data, anonymization of personal data, the Data Protection Officer (DPO), and consent. It presents the legal bases for the processing of personal data, bringing the exhaustive hypotheses of article 7 of the LGPD and the treatment of sensitive data. The methodology used in this research was based on the inductive method, from the perspective of an exploratory approach. Regarding technical procedures, it was based on bibliographic research and documentary research, including scientific articles, online surveys, and literary works relevant to the study, as well as legislation. Finally, it is understood that the full realization of the right to informational self-determination requires careful consideration of the extent to which the use of personal data maintains the fundamental rights of the data subject.
