It is known that Brazilian criminality, rampant impunity and the State's inability to punish and re-educate prisoners in an appropriate manner, directly affect and frighten the population of good. However, succumbing to delinquency and leaving them to mercy will never be an option. To this end, a study on Californian law Three Strikes Law, a pioneer in the strike system, motivated the creation of Qualified Transgression, to be applied in Brazil. The historical context, as well as legal aspects of that, were exposed. Then, in view of the legal principles and normative elements constituted in Brazil, the creation of Qualified Transgression is suggesteds, used as a plan, in the short and medium term, to suppress crime.
