Trombini, GabrielleDalmut, Polyana Gress2024-02-282024-02-282020https://repositorio.uricer.edu.br/handle/35974/518The present work deals with the atypical coercive measures, brought about by the 2015 Code of Civil Procedure, such as the Suspension of the National Driver's License and the Seizure of the Passport of the debtor. First, a survey is carried out based on concepts, executive titles, purpose of execution, principles, the types of execution, means of satisfying the debt and then it is discussed on coercive measures in the civil field. Subsequently, it was commented about the freedom of locomotion and finally on the possibility or not of the “CNH”- National Driver's License and passport cassation, with jurisprudential analyses. In order to apply the atypical measures, it is necessary to analyze each concrete case, verifying the existence of patrimony, good faith and also the private life of the executed. This work is intended to understand the emergence of the new measures used and to verify the legal consequences and also the legal security that such decisions will entail. The method used is the inductive one, through which it will be done the analysis of atypical measures will be used as a coercive means in the payment of debts.
