It is apparent that since the Brazilian Federal Constitution of 1988, which guaranteed Fundamental Rights for all, infra-constitutional laws needed to adapt. With regard to individuals with Autism Spectrum Disorder, the more specific laws concerning the recognition and protection of rights that cover areas such as inclusive education, labor rights, access to adequate treatments and health services, are recent. The legal system sought, through legislation, to also raise awareness in society about ASD. For parents, laws offer legal support, establishing rights and guarantees to ensure that their children with ASD have equal opportunities, educational inclusion, adequate medical support and, in the absence of the law, the judiciary has ensured through court decisions some of the rights mentioned.
