Sartori, Giana Lisa ZanardoMichelin, Bruno Vitório2024-02-272024-02-272020https://repositorio.uricer.edu.br/handle/35974/485The purpose of this paper is to address civil imprisonment for food debtors through an analysis of the arrest warrants issued and carried out in the District of Erechim and the situation of the pandemic (COVID-19). The authors state that survival is among the fundamental rights of the human person and that food credit is an adequate means to reach the necessary resources for the livelihood of those who cannot provide for their own survival. Human dignity is the macro principle of the Brazilian Federal Constitution of 1998 and underpins the right to collect food. In the monograph it was necessary to study the origin of food, its species and characteristics of the obligation to eat, to understand civil prison. The articles that provide the legal basis for the application of civil imprisonment for food were transcribed, analyzed and commented, in addition to the judgments of some Brazilian courts. Finally, an analysis of the arrest warrants of the District of Erechim was carried out, prepared by the Notary of the 3rd Family Court, Succession, Childhood and Youth and what methods were applied to satisfy the obligation before the arrest, and the challenges imposed by the situation of the COVID-19 pandemic in matters of collection of alimony.
