Dezordi, Evandro LuisDias, Ingrid Nunes2024-03-182024-03-182023https://repositorio.uricer.edu.br/handle/35974/642The objective of this project is to study, understand and elucidate the expropriation of assets with a sanctioning nature, to understand in what circumstances the expropriation of assets may occur, what the institute of expropriation is, making an analysis of the ways in which the property will fulfill its social function, the competent bodies to carry out this type of intervention on property and how the private owners of expropriated assets are compensated, whether for public need, public utility or social interest. For this purpose, doctrines from various experts on the subject were used, in the field of Administrative and Constitutional Law. This project is constituted of three sections that gradually deal with property rights up to the proposed theme. Finally, failure to comply with compliance within a certain period of time generates what is called sanctioning expropriation, in which the State can expropriate the property from the owner for not complying with the requirements. To carry out this research, the bibliographical research technique was used, through analysis of scientific articles, jurisprudence, doctrines and legislation.
