The objective was to identify and highlight the restrictive provisions within the Disarmament Statute concerning the full guarantee of the necessary means for the exercise of self-defense. Initially, the historical context of self-defense was addressed, followed by an examination of the legal requirements and technical aspects necessary for the configuration of this justification for illegality. The main restrictive provisions in the Disarmament Statute were identified and understood, and legislative suggestions were presented to minimize the limitations imposed by Law No. 10.826/03. These suggestions aim to ensure access to the necessary means for the full realization of the right to self-defense, securing the fundamental right to life as enshrined in Article 5 of the Federal Constitution. Furthermore, the study highlighted the importance of understanding the technical and legal aspects involving the institution of self-defense and the use of firearms as necessary means to guarantee this justification for illegality. It was concluded that the topic requires extensive research, with much still to be discussed, debated, and improved in Brazilian legislation. It is necessary to balance the fundamental rights provided in the Federal Constitution with individual guarantees. By enabling access to the necessary means for the exercise of self-defense, greater freedom of choice is provided to individuals, allowing them access to all available means for their defense. The methodology used in this research followed the deductive method, with an analytical descriptive approach.
