Sartori, Giana Lisa ZanardoTochetto, Ana Julha2024-03-072024-03-072022https://repositorio.uricer.edu.br/handle/35974/591The present research aimed to analyze the impacts of State omission in times of a pandemic on the dignity of the human person considering mysthanasia, an expression known as social euthanasia or miserable death. The purpose of the research to bring the concepts of modalities of end of life such as assisted suicide, euthanasia, orthothanasia, mysthanasia and dysthanasia, demonstrates that neither in life nor at the time of death the human being is fully provider of his choices and that, sometimes these moments can be marked by pain, contempt and abandonment. In addition, when investigating the main duties of the State in the light of the principle of the existential minimum, it was found that the Federal Constitution values numerous rights and duties, but often the minimum is not provided. Furthermore, the verification of the impacts of the State omission in the practice of mythanasia identified in Brazil during the pandemic, it can be concluded that society was not only affected by the disease, but also by the lack of social and economic structuring that will leave eternal marks. However, the scope of State accountability is still a controversial measure, due to the supporting factors. In this way, it appears that Brazil has never been prepared to provide the fundamental rights that ensure each person a dignified life, as provided for in the Federal Constitution of 1988. The inductive method was used, in the perspective of the descriptive analytical approach.
