Biasus, Alessandra ReginaGadini, Gabrieli Serafin2025-03-182024https://repositorio.uricer.edu.br/handle/35974/791The present academic work has the objective of discussing an issue that affects many contemporary family conflicts related to the dissolution of conjugal bonds: parental alienation.The primary goal is to reflect on the effectiveness of shared custody in cases of parental alienation, investigating whether this form of custody can truly prevent or combat alienating practices.To achieve this, an initial study on custody and its types within the legal framework was conducted, aiming to clarify its effects on the parent-child relationship. Then, the concept of parental alienation was detailed, distinguishing it from Parental Alienation Syndrome and examining its regulation under Brazilian law, specifically Law 12.318/2010.With these concepts clarified, the application of shared custody as an alternative to mitigate acts of parental alienation was analyzed. Doctrinal perspectives for and against this measure were explored, as well as an examination of its practical effectiveness through the analysis of Brazilian court rulings.
