It is assumed that some crimes most commonly committed against women in the form of domestic violence, such as threat and minor bodily injury, whose penalty established in the secondary precept of the criminal law, allow, in theory, the arbitration of bail. However, such crimes also allow for the decree of preventive detention, which justifies a careful analysis by the Police Authority of whether or not bail will be arbitrated. The research notes that there is a high risk for women if the aggressor is granted freedom on bail, pointing out the need for greater prudence in the analysis of extrication institutes, as is the case with bail. To this end, the study is divided into three chapters; Initially, the Maria da Penha Law - Law nº 11,340/2006, its fundamental concepts and the current context of domestic violence in Brazil are explored. Following this, the second chapter discusses the institution of bail in Brazilian criminal law, addressing its conceptual aspects, application, value and the obligations of the bailee. Having established these premises, the last chapter is dedicated to the actual analysis of the possibility or not of bail arbitration by the Police Chief in cases of domestic or family violence against women. Collating the constructed doctrinal positions, favorable and contrary to such an alternative.
