The family has undergone profound changes in the way it is organized, reflecting the State's need to welcome the various ways of forming a family without limiting the freedom of choice of individuals regarding the type of family group they intend to form. Thus, this research aims to investigate the rights and duties of the two institutions, besides pointing out the conceptual differences between the institutes and listing the possible causes in the increase of stable unions in the country. For this, the first two chapters outlined the characteristics, concepts, procedures and forms of dissolution of the two institutes. The bibliographical research of this work came across the statistics of various registries in Brazil, which showed by numbers, that couples are opting for the informal form of union instead of marriage, making the central objective of the work more latent, seeking thus, in the last chapter, addressing the existential effects on marriage and stable union, especially regarding the treatment given to the marital status of the subjects in these family arrangements, their rights and duties, as well as to point out the main differences between them, analyzing the property effects, property system, the forms of formalization of the stable union and marriage, as well as the forms of dissolution and the inheritance effects applicable to both institutes. In this way, it reflects on the recognition of marriage and stable union as institutions considered to be family entities, contributing to the researcher's education through the knowledge acquired and the development of research that allows for the analysis and understanding of the current social and legal reality.pt-BRDireitoUnião estávelCasamentoConstituição familiarTrabalho de Conclusão de Curso
