To this end, specific objectives were defined that guide the research, such as, for example, studying the civil liability of the State, including its historical evolution and the requirements necessary for its configuration, analyzing the different forms of exclusion from state responsibility, highlighting how students of Public schools are under the custody and responsibility of the State and the State is responsible in cases of accidents or damages to those who come under its custody. Using the inductive method used in the preparation of this work, it was possible to analyze the topic more comprehensively, thus delimiting the subjects, which will be dealt with specifically in each chapter. The choice of the theme of the State's civil liability in relation to public school students is justified by its social and legal relevance. Education is a fundamental right guaranteed by the Constitution, and the State has a duty to ensure a safe and suitable environment for learning.
