Resumo
O presente trabalho de conclusão de curso questiona, por meio da revisão bibliográfica e utilizando-se do método interpretativo sistemático das normas, a constitucionalidade da Emenda n.⁰ 96, de 2017, que ressalvou as práticas desportivas e manifestações culturais como práticas cruéis aos animais, em face à proteção jurídica dos animais no Brasil. Para tanto, examinará a proteção jurídica dos animais e a relevância da Constituição Federal de 1988 na matéria, e, a partir disso, o posicionamento do Supremo Tribunal Federal em face ao conflito de normas entre os direitos dos animais e demais interesses sociais. Em contrapartida, analisar-se-á a Emenda Constitucional n.⁰ 96, em seus aspectos formais e materiais, a fim de compreender a sua finalidade e suas implicações, buscando compreender ao final quais os limites do direito à manifestação cultural frente à ordem constitucional de direito ao meio ambiente equilibrado e a equiparação dos animais como sujeitos de direitos?
Abstract/Resumen
The present conclusion work of the course question, through this bibliographic revision and using the systematic interpretative method of norms, the amendment constitutionality n.⁰ 96, of 2017, which highlighted sports and cultural practices manifestations as cruel practices to animals, in face to juridical protection to animals in Brazil. Therefore, will examine the juridical protection of animals and the relevance to Federal Constitution of 1988 in the matter, and, from that, the position of Federal Court of Justice in face to conflict of standards between the animal rights and other social interests. In counterpart, will be analyzed the Constitutional Amendment n.⁰ 96, in its formal and material aspects, in order to understand its purpose and implications, seeking to understand, in the end, the limits of the right to cultural manifestation in face of the constitutional order of right to a balanced environment and the equalization of animals as rights subjects?
