Resumo

Esse estudo tem por objetivo analisar a adoção de crianças com deficiência sob a perspectiva legal e social. Devido à complexidade do assunto, foram observados os aspectos da origem e a da evolução ao longo do tempo, perpassando pelas mudanças legislativas, a participação do Código Civil, as formas de adoção e as medidas de apoio. Também objetiva-se esclarecer como ocorre o acolhimento em uma família substituta: a guarda, a tutela e a adoção. Além do acolhimento, são analisadas as causas do afastamento junto à família de origem de maneira a contribuir, resolver, superar efetivamente, para uma reintegração familiar como recomendado pelo ECA. E, por fim, analisar a adoção de crianças com deficiência: a proteção legal, a aceitação, a agilidade, o acolhimento, o vínculo, os laços afetivos e um olhar mais inclusivo. Compreender como está ocorrendo a adoção de crianças com deficiências no Brasil em termos jurídicos e sociais, as leis que objetivam agilizar essas adoções vêm em prol das crianças e da complexidade que cada caso apresenta, para que se possam oferecer os atendimentos e acompanhamentos para o quadro e as dificuldades que as mesmas apresentam. Para a realização da monografia foi utilizado o método indutivo, analítico descritivo, através da pesquisa bibliográfica. A legislação e suas orientações sobre a definição de critérios que demandam sobre maior urgência frente à adoção, elencando a inclusão como um direito protegido, dando aos deficientes e portadores de necessidades especiais acessarem livremente a estas oportunidades. Essa é uma das conquistas da Lei nº 12.955/2014, que prioriza a tramitação destas adoções, considerando a peculiaridade destes casos.

Abstract/Resumen

This study has the objective of analise the kids adoption with disability from a legal and social perspective. Due to the complexity of the theme, they have been observed the origins aspects and the evolution during the time, going through legislatives changes, the participation of Civil Code, the forms of adoption and the support meassures. It also aims to clarify how occurs the host in a substitute Family: the guard, the guardianship and the adoption. Beyond the host, the causes of the withdrawal are analyzed with the origin Family in order to contribute, solve, overcome effectively, for a reintegration familiar as recommended for ECA. And, lastly, analyse the adoption of kids with deficiency: the legal protection, the acception, the agility, the host, the bond, the affective bonds and a more inclusive look. Understand how is ocurring the adoption of kids with deficiency in Brazil in legal and social terms, the laws who aim to analyse this adoptions came in favor of kids and the complexity that each case features, so that the attendance and follow-up can be offered to the staff and the difficulties they presents. For the realization of the monography were used the individual method, analitic, descriptive, through the bibliografy research. The legislation and your orientations on the definition of criteria that demand greater urgensy in the face of adoption, listing inclusion as a protected right, giving disabled people with special needs free access to these opportunities. This is a conquest of the Law nº 12.955/2014, who prioritizes the processing of these adoptions, considering the peculiarity of these cases.
