Resumo
Permeando processos de investigação qualitativa, esta pesquisa objetivou desenvolver um estudo aprofundado sobre o Juizado Especial Cível, tendo como problemática verificar se o Juizado atua como um facilitador do acesso à justiça. Para isso, inicialmente foi analisada a origem histórica e a criação dos Juizados Especiais Cíveis. Após aborda-se a prestação jurisdicional e o fundamento constitucional. Também adentra nos princípios do acesso a justiça e da segurança jurídica elencando junto aos princípios vinculados ao Juizado Especial Cível. O objetivo da pesquisa é estudar de que forma o Juizado Especial Cível garante o acesso à justiça e representa a segurança jurídica nos assuntos ali tratados. O método utilizado para a pesquisa foi o indutivo, qualitativo, baseado nas legislações em vigor, desenvolvido por pesquisas bibliográficas e de artigos acadêmicos disponíveis.
Abstract/Resumen
Permeating qualitative investigation processes, this research aimed to develop an in-depth study about the Small Claims Court, having as a problem to verify if the Court acts as a facilitator of access to justice. For this, the historical origin and the creation of the Small Claims Court were first analyzed. Then, the jurisdictional provision and the constitutional basis. It also enters into the principles of access to justice and legal security, listing along with the principles linked to the Small Claims Court. The objective of the research is to study how the Small Claims Court guarantees access to justice and represents legal security in the matters dealt with. The method used for the research was inductive, qualitative, based on the legislation in force, developed
by bibliographic research and available academic articles.
