Resumo

O estudo, em síntese, consiste em analisar a influência da teoria do etiquetamento social nas decisões do tribunal do júri, visto que a rotulação estudada nesta linha criminológica está atrelada à própria sociedade, ou seja, as mesmas pessoas que julgam por sua íntima convicção no tribunal do júri. Dessa forma, a metodologia delimita-se ao estudo doutrinário da teoria do labelling aproach e suas vertentes, conceituando princípios constitucionais e a própria problemática das decisões imotivadas dos jurados. É necessário salientar que busca-se trazer uma crítica às decisões pela íntima conviccção, eis que ao entendermos os conceitos destacados, evidencia-se que a ausência da mínima motivação no júri popular acarreta em um prejuízo tanto para a acusação quanto para o réu. Por fim, destaca-se que não se pretende a extinção desse importante Instituto democrático, o que se pretende é analisar as problemáticas existentes, com o intuito de avaliar a necessidade de possíveis mudanças.

Abstract/Resumen

The study, in summary, consists of analyzing the influence of the theory of social labeling on the decisions of the jury, since the labeling studied in this criminological line is linked to society itself, that is, the same people who judge by their intimate conviction in the jury court. Thus, the methodology is limited to the doctrinal study of the theory of labeling approach and its aspects, conceptualizing constitutional principles and the very problem of the unmotivated decisions of the jurors. It is necessary to point out that it seeks to bring a critique to the decisions by the intimate conviction, behold, when we understand the highlighted concepts, it is evident that the absence of the minimum motivation in the popular jury causes damage to both the prosecution and the defendant. Finally, it is emphasized that the extinction of this important democratic Institute is not intended, what is intended is to analyze existing problems, in order to assess the need for possible changes.
