Trasvaloração e genealogia da moral no direito: uma perspectiva Nietzscheana

Resumo
Durante a história das sociedades existiu diversas formas de revoluções dos Direitos dos povos, entretanto, qual foi à razão pela qual ocorreu a mudança das leis? Mudança essa que vem do seu interior, pois quando se fala de mudança das leis, tem que ter em mente que se fala principalmente sobre a mudança de valores de certa parcela da sociedade. Ao ponto que se introduz a questão da troca de valores, foi proposta a análise de um de seus anunciadores, Nietzsche, que introduziu sua tese por meio da evolução do indivíduo com base na perca de ídolos, qual se referia a um abandono das crenças religiosas. Porém, esse abandono até chegar em uma vertente positiva passou por diversos males, que afetaram diretamente o comportamento do ser humano perante a sociedade. Males esse que o Nietzsche preferiu se referir como Niilismo. Anos após essa introdução da forma de pensamento sobre o declínio do ser humano, um filósofo moderno, Deluze, organizou em quatro espécies o Niilismo indicado por Nietzsche, sendo elas: Negativa, Positiva, Passiva e Ativa. Com a organização proposta por Deluze ficou mais fácil identificar a transformação dos valores e o ciclo que se seguia para a mesma. Entretanto, qual é o vinculo entre essa Transvaloração dita por Nietzsche e o Direito? Ela vem de uma forma simples, antes de se mudar e definir as leis de determinado lugar, indiferente de qual for e de sua forma de governo, seja déspota, Monárquico, Aristocrático, Representativo, todas as formas antes de qualquer alteração a ser feita, seja de forma conservadora ou Progressista, necessitada de uma mudança na forma de pensar, mudança essa vinda pela teoria Nietzscheana, a partir da Transvaloração. Ao ponto que os valores mudam, o Direito muda. Como base para tal pesquisa, foi usado o método de revisão bibliográfica.
Abstract/Resumen
During society history there was different forms of revolution on people rights, however, why did this changes happened? This change comes from within it, because when people discuss the change in laws, it has to keep in mind that it is mainly about changing the values of a certain part of society. When the idea about the change of values was introduced, the analysis of one of it announcers, Nietzsche, was proposed. He introduced his thesis on the evolution of the men based on the "loss of idols", which referred to an abandonment of beliefs religious. However, this abandonment, until reaching a positive aspect, went through several obstacles, which directly affected the behavior of human beings in society. Evil that Nietzsche preferred to refer to as Nihilism. Years after the thinking introduction about the decline of the human being, a modern philosopher, Deluze, organized the Nihilism indicated by Nietzsche into four species: Negative, Positive, Passive and Active. With the organization proposed by Deluze, it was easier to identify the transformation of values and the cycle that followed it. However, what is the link between this Transvaluation said by Nietzsche and the Law? In a simple way, before moving and defining the laws of certain place, regardless of which is and its form of government, whether despot, Monarchical, Aristocratic, Representative, all forms before any change is about to be done, whether in a conservative or progressive way, it needs a change of theway of thinking, a change that came from the Nietzschean theory, from the Transvaluation. As the values change, the Law changes.
