A violência cibernética contra a mulher: respostas adequadas ou necessidade de uma melhor legislação sobre o tema?

Resumo
O presente trabalho de conclusão de curso, tem como objetivo tratar sobre a constante evolução da violência contra a mulher na internet. O avanço tecnológico ao longo dos anos trouxe muitos benefícios, porém, com algumas consequências. Um dos principais males que a tecnologia pode proporcionar é a exposição excessiva, junto com a facilidade com que os criminosos podem atacar. O presente trabalho, portanto, busca entender as formas de violência virtual contra as mulheres e como se dá o acompanhamento da legislação acerca de tal tema. Então, é necessário compreender alguns conceitos, como o da sociedade da informação e da quarta revolução industrial, os quais servem para que se possa compreender todo o processo evolutivo da tecnologia, desde a criação do computador e da internet, até os dias atuais, em que dificilmente se encontrará alguém que não faça uso de ambos. Justamente por fazer parte do cotidiano da sociedade, a internet se tornou um dos meios mais visados pelos criminosos para cometer delitos. De golpes financeiros a compartilhamento de imagens íntimas, as mulheres são, por vezes, alvos dessas condutas. O trabalho, então, irá tratar sobre as principais, quais sejam, pornografia de vingança ou revenge porn, sextorsão, estupro virtual e cyberstalking. Em todas elas, a mulher tem sua vida virada de cabeça para baixo, afetando sua vida pessoal, social, e principalmente sua saúde mental. As condutas ainda são pouco conhecidas, apesar de serem muito praticadas. No entanto, só agora nos últimos anos é que elas têm ganhado atenção dos Poderes Judiciário e Legislativo e da mídia. A partir de 2012, inclusive, algumas leis foram sancionadas acerca de tal assunto. Contudo, apesar de tratar de alguns crimes digitais, referidas leis ainda não são completamente adequadas, sendo necessária a inclusão de uma adequação típica no ordenamento brasileiro que ampare legalmente a mulher vítima de crimes no âmbito virtual. Além disso, uma melhor adequação também se faz necessária para esclarecer eventuais dificuldades que o operador do direito possa ter no momento de enquadrar a conduta típica a algum crime. O método utilizado para essa pesquisa foi o bibliográfico e documental.
Abstract/Resumen
This course conclusion work aims to deal with the constant evolution of violence against women on the internet. Technological advances over the years have brought many benefits, however, with some consequences. One of the main evils that technology can provide is excessive exposure, along with the ease with which criminals can attack. The present work, therefore, seeks to understand the forms of virtual violence against women and how legislation on this subject is monitored. So, it is necessary to understand some concepts, such as the information society and the fourth industrial revolution, which serve to understand the entire evolutionary process of technology, from the creation of the computer and the internet, to the present day, in that you will hardly find anyone who does not make use of both. Due to the fact that it is part of the daily life of society, the internet has become one of the most targeted means by criminals to commit crimes. From financial scams to sharing intimate images, women are sometimes targets of these behaviors. The work, then, will deal with the main ones, which are revenge pornography or revenge porn, sextortion, virtual rape and cyberstalking. In all of them, the woman has her life turned upside down, affecting her personal and social life, and especially her mental health. The conducts are still little known, despite being widely practiced. However, it is only now in recent years that they have gained attention from the Judiciary and Legislative Powers and the media. As of 2012, some laws were enacted on this subject. However, despite dealing with some digital crimes, these laws are still not completely adequate, requiring the inclusion of a typical adaptation in the Brazilian legal system that legally supports the woman victim of crimes in the virtual environment. In addition, a better adaptation is also necessary to clarify any difficulties that the operator of the law may have when framing the typical conduct to some crime. The method used for this research was bibliographic and documentary.
