Resumo
A família tem sofrido profundas transformações em sua forma de organização, refletindo no Estado a necessidade de acolher as diversas formas de se constituir família sem, com isso, limitar a liberdade de escolha dos indivíduos quanto ao tipo
de grupo familiar que pretendem constituir. A Constituição Federal de 1988, além da família instituída pelo casamento, incluiu a formada pela união estável. Desta forma, a presente pesquisa tem por objetivo averiguar os direitos e deveres das duas
instituições, além de apontar as diferenças conceituais entre os institutos e elencar as possíveis causas no aumento de uniões estáveis no país. Para isso, nos dois primeiros capítulos, delineou-se sobre as características, conceitos, procedimentos e
as formas de dissolução dos dois institutos. A pesquisa bibliográfica do presente trabalho se deparou com as estatísticas de vários cartórios do Brasil, os quais demonstraram por meio de números, que os casais estão optando pela forma informal de união ao invés do casamento, fazendo com que, o objetivo central do trabalho ficasse mais latente, buscando-se assim, no último capítulo, abordar sobre os efeitos existenciais no casamento e na união estável, especialmente no que concerne ao tratamento dado quanto ao estado civil dos sujeitos nesses arranjos familiares, seus direitos e deveres, bem como, pontuar as principais diferenças entre ambos, analisando os efeitos patrimoniais, regime de bens, as formas de formalização da união estável e do casamento, bem como as formas de dissolução e os efeitos sucessórios aplicáveis a ambos os institutos. Deste modo, tece reflexões sobre o reconhecimento do casamento e da união estável como instituições consideradas entidades familiares, contribuindo na formação do pesquisador por meio dos conhecimentos adquiridos e no desenvolvimento da pesquisa que permitam analisar e compreender a atual realidade social e jurídica.

The family has undergone profound changes in the way it is organized, reflecting the State's need to welcome the various ways of forming a family without limiting the freedom of choice of individuals regarding the type of family group they intend to form. The family has undergone profound changes in the way it is organized, reflecting the State's need to welcome the various ways of forming a family without limiting the freedom of choice of individuals regarding the type of family group they intend to form. Thus, this research aims to investigate the rights and duties of the two institutions, besides pointing out the conceptual differences between the institutes and listing the possible causes in the increase of stable unions in the country. For this, the first two chapters outlined the characteristics, concepts, procedures and forms of dissolution of the two institutes. The bibliographical research of this work came across the statistics of various registries in Brazil, which showed by numbers, that couples are opting for the informal form of union instead of marriage, making the central objective of the work more latent, seeking thus, in the last chapter, addressing the existential effects on marriage and stable union, especially regarding the treatment given to the marital status of the subjects in these family arrangements, their rights and duties, as well as to point out the main differences between them, analyzing the property effects, property system, the forms of formalization of the stable union and marriage, as well as the forms of dissolution and the inheritance effects applicable to both institutes. In this way, it reflects on the recognition of marriage and stable union as institutions considered to be family entities, contributing to the researcher's education through the knowledge acquired and the development of research that allows for the analysis and understanding of the current social and legal reality.
