Resumo
A presente monografia objetivou analisar o instituto da Guarda Compartilhada e os direitos e deveres que os genitores devem ter em relação aos seus filhos, enfatizando a sua aplicabilidade no Direito Brasileiro. Em tempos de pandemia pelo COVID-19 a situação do direito de convivência de crianças e adolescentes que vivem as situações de pais divorciados se evidenciou. O instituto da guarda compartilhada surgiu com o intuito de atender as necessidades deste modelo novo de família, que mesmo após a ruptura conjugal, requer que a relação entre pais e filhos seja o mais amável possível, que ambos os genitores possam permanecer presentes na vida dos filhos. Ao ser compartilhado o tempo com a prole, ambos os genitores participariam conjuntamente na vida dos filhos, levando sempre em conta o melhor interesse da criança. Sendo assim, na pesquisa monográfica pretendeu-se demonstrar a importância da família e os laços afetivos dos filhos com seus genitores, e como isso pode ocorrer evitando efeitos negativos que a dissolução conjugal trouxe para o lar. O método utilizado para a realização da pesquisa foi o indutivo, analítico descritivo através da técnica de pesquisa bibliográfica.

This monograph aimed to analyze the Shared Guard institute and the rights and duties that parents must have in relation to their children, emphasizing its applicability in Brazilian Law. In times of pandemic by COVID-19, the situation of the right of
coexistence for children and adolescents who live as situations of divorced parents became evident. The shared custody institute was created with the aim of meeting the need for this new model of family, which, even after the marital breakdown, requires that the relationship between parents and children be as kind as possible, that both parents can remain present in the lives of their parents. taking into account the child's best interest. Therefore, in the monographic research, it was intended to demonstrate the importance of the family and the affective bonds of the children with their parents, and how this can occur avoiding the negative effects that the marital dissolution brought to the home. The method used to carry out the research was inductive, analytical and descriptive through the technique of bibliographic research.
