Resumo

A previdência social é um tema de grande importância para a sociedade brasileira, pois desempenha um papel fundamental na proteção social e no amparo aos cidadãos, garantindo-lhes segurança financeira em momentos de vulnerabilidade, como a aposentadoria, doença ou invalidez. Nesse contexto, a qualidade de segurado, a contribuição e a filiação emergem como conceitos essenciais para a operacionalização desse sistema de proteção social. A filiação estabelece o vínculo entre o segurado e o sistema previdenciário, definindo quem pode fazer parte desse sistema. A contribuição, por sua vez, representa a principal fonte de financiamento do sistema previdenciário, sendo paga tanto pelos trabalhadores como pelos empregadores. Já a qualidade de segurado refere-se à condição necessária para que um indivíduo possa usufruir dos benefícios previdenciários, estando atrelada à regularidade de suas contribuições ou ao cumprimento de determinados requisitos. No entanto, é no contexto do produtor que exerce atividade agropecuária que surge a figura do segurado especial, um grupo específico de trabalhadores rurais que, devido às particularidades de sua ocupação, são sujeitos a critérios diferenciados para o reconhecimento de sua qualidade de segurado. Os segurados especiais representam uma parte significativa da força de trabalho no campo e têm uma importância econômica crucial para o setor agrícola, mas muitas vezes enfrentam dificuldades em cumprir os requisitos tradicionais de contribuição previdenciária devido às sazonalidades e à informalidade de suas atividades. Assim, esta monografia tem como objetivo realizar uma análise dos requisitos estabelecidos para o reconhecimento da condição de segurado especial para o produtor que exerce atividade agropecuária. Será abordado o embasamento legal que regula essa categoria de segurados, levando em consideração as peculiaridades de seu trabalho no campo e as adaptações necessárias no sistema previdenciário para garantir sua proteção social. A pesquisa se aprofundará nas legislações pertinentes, jurisprudências e estudos de caso, visando a uma compreensão abrangente dos desafios e possíveis melhorias no reconhecimento e na garantia dos direitos previdenciários para esses trabalhadores rurais, promovendo, assim, uma maior inclusão e justiça social no contexto da Previdência Social brasileira. Para realização da presente pesquisa utilizou o método indutivo, através de pesquisas bibliográficas e documentais, bem como estudo de caso.

Abstract/Resumen

Social security is a topic of great importance for Brazilian society, as it plays a fundamental role in social protection and support for citizens, guaranteeing them financial security in times of vulnerability, such as retirement, illness or disability. In this context, the quality of insured, contribution and membership emerge as essential concepts for the operationalization of this social protection system. Affiliation establishes the link between the insured person and the social security system, defining who can be part of this system. The contribution, in turn, represents the main source of financing for the social security system, being paid by both workers and employers. The status of insured refers to the necessary condition for an individual to enjoy social security benefits, being linked to the regularity of their contributions or the fulfillment of certain requirements. However, it is in the context of the producer who carries out agricultural activities that the figure of the special insured arises, a specific group of rural workers who, due to the particularities of their occupation, are subject to different criteria for the recognition of their status as insured. Specially insured people represent a significant part of the rural workforce and have a crucial economic importance for the agricultural sector, but they often face difficulties in meeting traditional social security contribution requirements due to the seasonality and informality of their activities. Therefore, this monograph aims to carry out an analysis of the requirements established for the recognition of special insured status for producers who carry out agricultural activities. The legal basis that regulates this category of insured people will be discussed, taking into account the peculiarities of their work in the field and the necessary adaptations in the social security system to guarantee their social protection. The research will delve deeper into the relevant legislation, jurisprudence and case studies, aiming at a comprehensive understanding of the challenges and possible improvements in the recognition and guarantee of social security rights for these rural workers, thus promoting greater inclusion and social justice in the context of Brazilian Social Security. To carry out this research, the inductive method was used, through bibliographic and documentary research, as well as case studies.
