Resumo

O presente trabalho teve como objetivo entender a efetividade e o possível simbolismo do novo tipo penal de violência psicológica, esta se desenvolve como um processo silencioso, é a forma mais pessoal de agressão contra a mulher, sendo que as palavras têm um forte poder para ferir, fragilizar e impactar a autoestima de uma mulher. No entanto, aponta-se como um grande problema a dificuldade na identificação da violência psicológica, em razão de esta aparecer diluída em atitudes aparentemente não relacionadas ao conceito de violência. Desse modo acredita-se que será mais um mecanismo visto como simbólico na luta a violência contra a mulher, pois será difícil este novo tipo penal acontecer de forma que venha acompanhado de provas suficientes. Assim o crime de violência psicológica contra a mulher, sua aplicação não é efetuada, deixando de concretizar a proteção garantida à mulher, em especial, na Lei Maria da Penha. Tendo como resultado, apesar de toda a evolução das mulheres, a insuficiência do novo tipo penal, junto à Lei Maria da Penha. Para tanto, utilizou-se a metodologia de pesquisa bibliográfica, buscando referências que ampliassem a compreensão do tema abordado.

Abstract/Resumen

The present work aimed to understand the effectiveness and possible symbolism of the new criminal type of psychological violence, it develops as a silent process, it is the most personal form of aggression against women, and words have a strong power to hurt, weaken and impact a woman's self-esteem. However, the difficulty in identifying psychological violence is pointed out as a major problem, as it appears diluted in attitudes apparently unrelated to the concept of violence. In this way, it is believed that it will be another mechanism seen as symbolic in the fight against violence against women, as it will be difficult for this new criminal type to happen in a way that is accompanied by sufficient evidence. Thus, the crime of psychological violence against women, its application is not carried out, failing to materialize the protection guaranteed to women, in particular, in the Maria da Penha Law. As a result, despite all the evolution of women, the insufficiency of the new criminal type, together with the Maria da Penha Law. Therefore, the methodology of bibliographic research was used, seeking references that would broaden the understanding of the topic addressed.
