O presente Trabalho de Conclusão de Curso traz como objetivo demonstrar e elucidar a vinculação orçamentária publica mínima, nos setores de educação e saúde à discricionariedade constitucional ampla no planejamento e execução orçamentária, frente a repercussão nos limites do controle judicial. O estudo se dará a partir da evolução histórica da Constituição Federal de 1988 dos direitos sociais, quanto à liberdade relativa às alocações orçamentárias, discutindo a pertinência das ideias de discricionariedade e vinculação na concepção das políticas públicas, enfrentando a viabilidade de controle judicial.

Abstract
This course conclusion work aims to demonstrate and elucidate the minimum public budget link, in the education and health sectors, to the broad constitutional discretion in budget planning and execution, in view of the repercussion in the limits of judicial control. The study will be based on the historical evolution of Federal Constitution of 1988of social rights, regarding freedom regarding budget allocations, discussing the pertinence of the ideas of discretion and binding in the design of public policies, facing the feasibility of judicial control.
