Resumo

Esta monografia busca compreender se no ordenamento jurídico brasileiro existem meios legais para o controle e conscientização a respeito do cyberbullying. Buscando-se brevemente analisar a evolução da rede mundial de computadores e sua importância para o tema, haja vista que com o surgimento da internet moderna, o modo de interação entre as pessoas se modificou. No que diz respeito à prática do bullying visa tentar entender o que é a prática. Qual é a sua conceituação, como ocorre, onde ocorre, quais são as maiores dificuldades em seu combate. Também, procura as consequências da prática para as crianças e adolescentes, e inclusive, plausíveis soluções para amenizar o problema. Além disso, intentou-se à pesquisa e análise das principais decisões do tema na esfera civil, em especial, e penal. A metodologia utilizada fora a pesquisa bibliográfica, por meio de livros, artigos, doutrina e legislação pertinente. O método de abordagem aplicado fora o indutivo. Quanto ao procedimento se utilizou o método analítico descritivo.

Abstract/Resumen

This monograph seeks to understand whether in the Brazilian legal system there are legal means to control and raise awareness about cyberbullying. Seeking to briefly analyze the evolution of the world wide web and its importance for the theme, considering that with the emergence of the modern internet, the mode of interaction between people has changed. With regard to the practice of bullying, it aims to try to understand what the practice is. What is its conceptualization, how it occurs, where it occurs, what are the greatest difficulties in its combat. It also looks for the consequences of the practice for children and adolescents, and even plausible solutions to alleviate the problem. In addition, an attempt was made to research and analyze the main decisions on the subject in the civil sphere, in particular, and in the criminal sphere. The methodology used was bibliographical research, through books, articles, doctrine and relevant legislation. The approach method applied was the inductive one. As for the procedure, the descriptive analytical method was used.
