Resumo

O presente trabalho versa sobre a Justiça Restaurativa como um novo caminho para a resolução de conflitos, problemas, ou infração no ambiente escolar. Com a promulgação do Código de processo Civil de 2015, os meios consensuais de resolução de conflitos ganharam grande destaque no mundo jurídico, porem a justiça restaurativa depende ainda do legisla dor em disciplinar tal instituto no Código Penal e Código de Processo Penal. Contudo, muitos projetos vêm sendo implantados com foco na justiça restaurativa no país, especificadamente na cidade de Porto Alegre/RS, onde a justiça restaurativa é utilizada nos CEJUSCs , no qual além de resolver as raízes do conflito, trabalha com as partes, ou seja, vítima, ofensor, e comunidade, restabelecendo o respeito. A justiça restaurativa ainda prevê a realização dos círculos restaurativos, onde pode tanto ser tratado com o conflito em si, como também, a prevenção de futuras controvérsias. A metodologia utilizada no presente trabalho foi a da pesquisa bibliográfica qualitativa, o método de abordagem é indutivo e o método de procedimento é analítico descritivo.

Abstract/Resumen

The present work deals with Restorative Justice as a new way for the resolution of conflicts, problems, or infraction in the school environment. With the promulgation of the 2015 Code of Civil Procedure, consensual means of conflict resolution gained great prominence in the legal world, but restorative justice still depends on the legislature to discipline such an institute in the Penal Code and Code of Criminal Procedure. However, many projects have been implemented with a focus on restorative justice in the country, specifically in the city of Porto Alegre / RS, where restorative justice is used in CEJUSCs, in which in addition to resolving the roots of the conflict, it w orks with the parties, ie , victim, offender, and community, restoring respect. Restorative justice still provides for the establishment of restorative circles, where it can be both dealt with in the conflict itself, as well as the prevention of future controversies. The methodology used in this work was the qualitative bibliographic research, the approach method is inductive and the procedure method is analytical descriptive.
